Dealerships and Consumer Claims

A significant portion of the firm’s practice is devoted to the representation of automobile dealerships, automobile finance companies, automobile repossession companies and garage liability insurers. JPPO provides a broad range of services to dealerships, from acting as general counsel on various matters to providing representation on specific legal matters. The range of services we provide includes everything between drafting buy-sell agreements and commission pay plans, to resolving sales and leasing matters and employment practices and franchise law matters. The firm has considerable experience in defending consumer claims and class action lawsuits brought under the Truth-In-Lending Act, Equal Credit Opportunity Act, Fair Credit Reporting Act, Fair Debt Collection Practices Act, Minnesota Motor Vehicle Retail Installment Sales Act and Consumer Fraud Act, as well as claims alleging violations of state and federal odometer and salvage laws and invasion of privacy claims.

As the laws and regulations affecting the automobile retail industry become more cumbersome, success in the courtroom depends upon the selection of attorneys who are knowledgeable and skilled in this type of litigation.

Members of the firm have been involved in virtually every significant dealership and garage liability case law decision over the past decade. While the firm defends lawsuits brought by individual consumers in both state and federal court, it has also successfully represented the Greater Metropolitan Auto Dealers Association ("GMADA") in regulatory enforcement matters with the Department of Commerce.

While litigation is a major focus at JPPO, we also work with clients to adopt preventive practices to help reduce risk and exposure to litigation. JPPO has been regularly engaged by dealerships and their garage insurers to provide compliance training, and we have drafted significant legislation, rental contracts, and policy forms for dealerships and garage insurers to reduce their liability and litigation exposure. The firm has conducted harassment and discrimination training for dealerships and has written employment practices procedure manuals and commission pay plans for several dealership clients. JPPO provides regular legal updates to its clients in an effort to identify and address issues before they become a problem. Members of the firm are frequently invited to meetings of various trade associations to keep them appraised of litigation and legal issues that may affect their member dealerships
