Gregory J. Johnson has practiced exclusively in civil defense litigation since graduating magna cum laude from William Mitchell College of Law in 1989. In 1985, Greg obtained a Business Administration degree, majoring in finance, from Minnesota State University at Mankato, graduating cum laude. Prior to starting the law firm in 1995 in downtown St. Paul, Greg practiced for several years at an insurance defense firm in Minneapolis, Minnesota. He is AV rated by Martindale Hubbell, its highest rating, and has been awarded "Super Lawyer" status by Minnesota Law & Politics, an annual award bestowed upon approximately 6% of Minnesota attorneys, on five occasions.
Greg's practice is primarily focused upon the defense of consumer and commercial finance litigation. He has represented a broad spectrum of consumer finance clients, including automobile dealerships, finance companies, banks, real estate brokers, and repossession companies. He has considerable experience in defending consumer claims brought under federal and state laws and regulations such as the Truth-In-Lending Act, Equal Credit Opportunity Act, Fair Credit Reporting Act, Fair Debt Collection Practices Act, Minnesota Motor Vehicle Retail Installment Sales Act and Consumer Fraud Act, as well as claims alleging violations of state and federal odometer laws, usury, deceptive trade practices, credit discrimination and invasion of privacy. He has considerable experience in defending class action litigation and has also served as a consultant on consumer litigation around the country.
Greg's family owned an automobile dealership in the 1970's and 1980's. This, coupled with his undergraduate degree in finance, naturally led him to gravitate toward representation of automobile dealerships and the defense of creditor rights. Greg provides a broad range of services to our clients, acting as general counsel to dealerships on various legal matters, to acting as liaison counsel for garage liability carriers and providing legal representation on specific legal matters. He has been involved in virtually every significant dealership and garage liability case law decision in Minnesota over the past decade. A listing of some of his published decisions are identified below. While Greg defends lawsuits brought by individual consumers in both state and federal court, he has also successfully represented the Greater Metropolitan Auto Dealers Association ("GMADA") in regulatory enforcement matters with the Department of Commerce. The range of services he provides include everything between drafting partnership buy-sell agreements and commission pay plans, to resolving sales and leasing matters and employment disputes. As the laws and regulations affecting the automobile retail industry become more complex and cumbersome, success in the courtroom depends upon the selection of an attorney who is knowledgeable and skilled in this area. There are few legal issues affecting the industry that Greg has not encountered and successfully resolved.
While litigation is a major focus at J&P, Greg also works with clients to adopt preventive practices to help reduce risk and exposure to litigation. He has been regularly engaged by dealerships and their garage insurers to provide compliance training and has drafted significant legislation, rental contracts and policy forms for dealerships and garage insurers to reduce their liability and litigation exposure.
He provides legal updates to firm clients in an effort to identify and address issues before they become a problem. Greg is frequently invited to meetings of various trade associations in the automobile and insurance industry to keep them appraised of litigation and legal issues that may affect their members.
Greg also has vast experience in defending accident claims involving rental and loaner vehicles. A prolific writer and speaker, he co-authored the 1991, 1994, 2000 and 2001 editions of the
Minnesota Motor Vehicle Insurance Manual , a treatise that has been recognized by Minnesota courts as an authority on automobile law. Greg has also drafted rental car contracts, temporary substitute loaner agreements and manuscript policy endorsements for dealership, rental car, and insurance clients. Over the past decade, he has been involved in several of the most significant case law decisions affecting the rental car industry, ranging from case law decisions addressing the priority of payment of liability claims to the constitutionality of the statutory caps on vicarious liability for rental car owners.
Greg also has comprehensive an in-depth knowledge of coverage forms and has written several publications on insurance coverage matters, including
The Commercial General Liability Coverage Form: What's Covered and What's Not? A Comprehensive Review of Minnesota Case Law Interpreting the Form
, (National Business Institute 1997) and
Miller-Shugart Settlements and the Claims Professional: Recognizing and Understanding the Exposure and Using it as an Effective Settlement Tool, (1995). He is frequently asked to provide coverage opinions and defend insurance coverage disputes in declaratory judgment actions at the trial level and on appeal. He has appeared before the Minnesota Supreme Court and Court of Appeals in coverage related matters on numerous occasions and has successfully defended
Miller-Shugart claims as well as claims alleging bad-faith against our insurer clients.
In his spare time, Greg enjoys spending time with his family, collecting sports memorabilia and coaching youth basketball, football and baseball. He is also on the Board of Directors for the Eastview Athletic Association (EVAA) Football in Apple Valley, Minnesota and is the Program Director for its traveling program.
